ICJL President: Bogus Arguments, Bogus Documentary
The label on the back of a pot of coffee Folger Roast instant classic, purchased Wednesday, June 29, in a suburb of Chicago, reads almost exactly like the label on the instant coffee purchased in 1995:
Directions: Use one teaspoon per 6 fl slightly rounded. Oz cup, add boiling water, stir.
The principles of physics have not changed since the early 1990 either. Water boils at 212 degrees. It's hot, very hot. Some coffee makers recommend 180 degrees for better taste, but it is still hot.
If a McDonald's drive-through worker spills a hot cup of coffee on a customer, it makes sense and reason that McDonald's should take responsibility. If an injury is serious, responsibility and compensation, could be severe. There is no argument.
But that's not what happened to Stella Liebeck's lawyers in 1992 and personal injury trials, including those of Illinois, want to continue to perpetuate a myth.
McDonald's "hot coffee" story has been around since the mid-1990s.This was the case of a woman of 79 years in New Mexico (Stella Liebeck) who tried to remove the lid of a cup of coffee she had purchased at a McDonalds. She placed the cup between his knees, he knocked and was scalded.
At no time was there a charge that the employee voluntarily provided the McDonald's coffee on the late Stella Liebeck (his death was not caused by his carelessness with a hot cup of coffee).
There were accusations that the coffee was too hot, but none suggested that it was still hot.
Although the incident occurred in New Mexico, this case was of particular interest in Illinois - not because of where it happened - but because society is based McDonald in Illinois (Oak Brook) and also because it reached a peak in media attention at precisely the same time, Illinois legislators were considering a comprehensive "tort reform" legislative proposal.
