Tigers slugger Miguel Cabrera's DUI case pushed to July 12

Detroit Tigers star Miguel Cabrera will have to wait a little longer before knowing if he's headed to trial in his Florida DUI case.

Cabrera’s attorney, Michael Kessler, filed for a continuance on June 7 and County Judge Cliff Barnes last week granted the request without objection from prosecution, according to court records.

It was the second continuance at the applicant’s request. The new status conference hearing is set for 1:30 p.m. on July 12.

Court prosecutor Gayle Braun said the hearing acts as a settlement and negotiation appearance and an opportunity to handle any pending motions.

“I would never rule out a plea, but at this point, there hasn’t been any plea agreement reached," Braun said. “So, as of now, it would go to trial.”

It has been more than four months since Cabrera, 28, was charged with DUI and two counts of resisting an officer without violence. He was also cited for having an open container of alcohol in his 2005 Land Rover and was drinking Scotch from a bottle on a rural highway in Ft. Pierce, according to a St. Lucie County Sheriff Office report.

The right to a trial 90 days after the arrest was waived by the court, a St. Lucie County (Fla.) court clerk confirmed.

Major League Baseball’s All-Star Game is scheduled on July 12 and Cabrera is expected to be considered a representative. He is not is not required to appear at the rescheduled hearing if represented by an attorney.

Barnes initially set the original status conference hearing for Thursday, but the case docket sheet revealed the hearing to be scheduled for July 12 when the order came through, Braun said.

If found guilty on the DUI charge, Cabrera's maximum penalty carries a six-month county jail sentence, $1,000 fine and a 12-month suspended driving license.
